Aviation Law Fundamentals

Module 1 — Introduction to International Aviation Law

Students are introduced to the international legal framework governing civil aviation, including the importance of treaties, national aviation legislation and international standards. Particular attention is given to the Convention on International Civil Aviation and the role of the International Civil Aviation Organization (ICAO).

Module 2 — Airspace and State Jurisdiction

Students examine the principle that States exercise sovereignty over the airspace above their territory and learn how international aviation law regulates the use of that airspace. The course introduces the legal distinction between national airspace and areas beyond national sovereignty.

Module 3 — Aircraft Registration and Nationality

Students learn why aircraft registration is legally significant and how registration connects an aircraft with the State whose nationality it bears. The course introduces basic principles concerning registration, identification and the responsibilities associated with aircraft nationality.

Module 4 — Aviation Safety and Security

Students examine the importance of international aviation safety standards, aircraft operational requirements, licensing and oversight. The course also introduces aviation-security obligations designed to prevent unlawful interference with civil aviation.

Module 5 — Aviation Liability and Passenger Rights

Students are introduced to the international legal framework concerning liability for injury, death, baggage loss, cargo damage and delay. The course emphasises the importance of identifying the applicable treaty, jurisdiction and contractual circumstances before assessing liability.

Module 6 — Environmental Protection and International Cooperation

Students examine the growing role of international aviation law in addressing aircraft emissions, noise and other environmental impacts. They also learn why aviation requires cooperation between States, airlines, airports, regulators and international organisations.
