International Family Law

Module 1 — Foundations of International Family Law

Students are introduced to family disputes involving more than one jurisdiction and the interaction between domestic family law and international legal instruments. The course emphasises that family law remains substantially governed by national law while international rules may coordinate jurisdiction, cooperation and recognition.

Module 2 — International Marriage and Divorce

Students examine basic legal questions arising when marriages are formed, dissolved or challenged across borders. The course introduces recognition of marriages and divorces and the importance of determining which jurisdiction and legal rules apply.

Module 3 — Parental Responsibility and Child Protection

Students examine parental responsibility, custody and child-protection issues in international cases. The course emphasises the welfare and rights of the child, lawful jurisdiction and appropriate safeguards.

Module 4 — International Child Abduction

Students are introduced to international child-abduction disputes and the legal mechanisms designed to address wrongful removal or retention of children across borders. The course stresses careful application of the relevant treaty, domestic law and factual circumstances.

Module 5 — International Cooperation and Evidence

Students learn why cross-border family cases may require cooperation between courts and authorities, including service of documents, obtaining evidence and communicating relevant information. The course emphasises lawful information sharing and protection of vulnerable persons.

Module 6 — Recognition and Enforcement of Family Decisions

Students examine the basic principles governing recognition and enforcement of foreign family judgments and orders. The course introduces jurisdictional requirements, public-policy considerations and the importance of checking the specific international or domestic framework applicable to the case.
