Judicial Ethics, Independence and Conflicts

Module 1 — Judicial Independence

This module introduces judicial independence as a foundation of fair adjudication. A Judge must exercise judicial functions independently and must not allow improper pressure, personal interests or external influence to determine a judicial decision.

Module 2 — Impartiality and Equal Treatment

Students learn the importance of impartiality and equal treatment of parties. Judicial decisions must be based on the applicable legal framework, the evidence properly before the Court and the issues that the Court is authorised to determine.

Module 3 — Conflicts of Interest

This module introduces actual, potential and apparent conflicts relevant to judicial service. Where a conflict is identified, the Judge must follow the applicable Court rules and disclose or address the conflict through the proper procedure.

Module 4 — Judicial Ethics and Professional Conduct

Students learn the importance of integrity, honesty, dignity, restraint, confidentiality and responsible conduct. Judicial office carries responsibilities both inside and outside formal hearings.

Module 5 — External Influence and Improper Communication

Students learn to recognise improper attempts to influence judicial decision-making. Private communications concerning a matter before the Court must be handled according to applicable Court procedures and confidentiality requirements.

Module 6 — Accountability and Ethical Decision-Making

This module explains that judicial independence does not remove accountability. Ethical concerns, conflicts and professional misconduct should be addressed through established procedures while protecting the independence of judicial decision-making.
