Judgments, Sentencing and Remedies

Module 1 — The Purpose and Structure of a Judgment

This module introduces the purpose of a judicial judgment and the importance of a clear structure. A judgment should identify the issues, relevant findings, applicable law, reasoning and conclusions material to the case.

Module 2 — Findings, Reasons and Conclusions

Students learn how factual and legal findings are connected to the final decision. Material conclusions should be supported by reasons that explain how the Court reached them from the evidence and applicable legal framework.

Module 3 — Determining Sentence Within the Legal Framework

This module introduces judicial sentencing as a function governed by the applicable Treaty, Court rules and other authorised legal provisions. A Judge must not create a punishment that has no legal basis.

Module 4 — Proportionality and Relevant Sentencing Factors

Students learn to consider the legally relevant circumstances identified by the governing framework when determining sentence. Judicial discretion must remain within the authorised range and must be exercised consistently with applicable principles.

Module 5 — Remedies and Judicial Orders

This module introduces remedies and other judicial orders that may be available where authorised. Students learn to distinguish criminal punishment from other forms of relief or order and to identify the legal basis for the remedy granted.

Module 6 — Finalising and Communicating the Judgment

Students learn how a final judgment should clearly state the Court’s decision, material orders and reasons. The judgment should be sufficiently clear for the parties, Court officials and any applicable review process.
