Module 1 — Purpose of Appeals and Judicial Review

This module introduces the purpose of appellate and judicial review processes. Review provides a structured means of examining decisions according to the applicable Court framework and does not simply replace one Judge’s preference with another.

Module 2 — Grounds and Scope of Review

Students learn to identify the legal and procedural grounds on which a decision may be reviewed. The scope of review depends on the applicable rules and the nature of the decision being challenged.

Module 3 — Reviewing Law, Facts and Procedure

This module examines how review may concern legal interpretation, material findings, evidential or procedural issues where authorised, and other recognised grounds. Review must remain within the authority granted by the governing framework.

Module 4 — Appellate Reasoning

Students learn how an appellate decision should identify the issue under review, examine the relevant reasoning and determine the legally available response. Appellate reasoning should be independent, structured and supported by reasons.

Module 5 — Available Outcomes and Remedies

This module introduces possible outcomes where authorised, such as affirming, varying, setting aside or remitting a decision, together with other applicable remedies. The Court must use only outcomes available under the governing framework.

Module 6 — Writing a Review Decision

Students learn how to prepare a clear review decision identifying the grounds, relevant legal framework, analysis, conclusion and any resulting order. The decision should explain why the review outcome follows from the issues properly before the reviewing body.
