Treaty Law and Interpretation

Module 1 — Treaties and International Law

Students are introduced to treaties as formal international agreements governed by international law. The course examines why treaties are created and how they establish rights, obligations, institutions and procedures for their parties.

Module 2 — Formation, Signature and Ratification

Students learn the basic stages through which States may express consent to be bound by a treaty, including signature, ratification, acceptance, approval and accession where applicable. The course distinguishes political approval from the international legal act that establishes consent.

Module 3 — Reservations and Treaty Participation

Students examine reservations and the circumstances in which a State may seek to modify the legal effect of particular treaty provisions in its application to that State. The course introduces the need to assess reservations against the treaty's object and purpose and other applicable rules.

Module 4 — Treaty Interpretation

Students are introduced to the general principles of treaty interpretation, including interpreting treaty terms in good faith according to their ordinary meaning in context and in light of the treaty's object and purpose. Relevant supplementary materials may be considered where appropriate.

Module 5 — Performance, Breach and Responsibility

Students learn the principle that treaties in force must generally be performed in good faith and examine the legal significance of breach. The course distinguishes treaty obligations from other forms of international responsibility and stresses the importance of identifying the applicable legal framework.

Module 6 — Amendment, Termination and Dispute Settlement

Students examine how treaties may be amended, suspended or terminated under applicable law and treaty provisions. The course also introduces negotiation, mediation, arbitration and judicial settlement as possible methods for resolving treaty disputes.
