FICTIONAL DEMONSTRATION JURISDICTION DETERMINATION DEMO-0003 — FOUNDING TREATY JURISDICTION REVIEW IMPORTANT NOTICE This determination is fictional demonstration material created solely to demonstrate the proposed Court's judicial workflow. It has no legal effect and must not be treated as a real judgment or legal determination. 1. ISSUE The Court was asked to determine whether, under the Founding Treaty, jurisdiction may arise in respect of a respondent who is outside the territorial jurisdiction of the Court, does not recognise the Court, and does not participate in the proceedings. 2. NON-APPEARANCE The respondent was properly recorded as invited but did not participate in the demonstration hearing. The judicial process is therefore demonstrated as capable of continuing where the applicable founding instrument permits proceedings to continue without the respondent's participation. 3. JURISDICTION For this fictional demonstration, the judicial panel determines that the Court's jurisdiction is derived from the Founding Treaty and is not defeated solely by the respondent's non-recognition of the Court or non-appearance. 4. JUDICIAL DETERMINATION AND ENFORCEMENT The Court's judicial determination is distinct from physical enforcement. The Court does not acquire authority to enter another jurisdiction and physically arrest a person merely because the Court has issued a determination. For demonstration purposes, any enforcement consequence must operate through the lawful authority of a State or other competent authority acting within its own jurisdiction and applicable obligations. Accordingly, a person outside the territorial reach of the Court may remain outside that reach unless and until the person comes within a jurisdiction where lawful enforcement of the Court's determination is available. 5. DETERMINATION The jurisdictional question is determined in favour of the Court's jurisdiction for the purposes of this fictional demonstration. The respondent's non-recognition and non-appearance do not, by themselves, prevent the Court from proceeding or recording its judicial determination where jurisdiction is otherwise established under the Founding Treaty.
