Financial Independence
This page records the proposed funding principle requested for the Court. It should be formally adopted through the appropriate legal instrument before being represented as a binding Treaty rule.
No Government Funding
The Court is intended to be financially independent of governments and political authorities. Government, ministry, political-party or public-authority funding intended to control, influence or condition the Court's independent functions is not permitted under this proposed policy.
Donor independence
- Donations must not purchase or influence judicial, prosecutorial, investigative or enforcement decisions.
- Donations carrying conditions that compromise independence should be refused or returned where lawful.
- Conflicts of interest and suspicious funding should be subject to appropriate review.
- Anonymous donations may be offered after lawful payment and compliance systems are established.
- Anonymous to the public does not mean exempt from lawful identity, fraud, tax or financial-compliance requirements.
